Service Terms and Conditions

I, the undersigned, hereby warrant and represent to Hazyview Aerial Cable Trail (Proprietary) Limited (hereinafter referred to as “the owner") that:

1. I am aware that there are inherent dangers in any outdoor activity and excursion. I am aware that I am exposing myself to these by participating in the activities or transportation organised by the owner. The activity takes place in pristine indigenous forest where conservation is paramount. I understand it is an offence to interfere with, damage, pollute, or act in any way deemed to be detrimental to the environment. Should I fail to comply with any instructions in this regard thereby interfering with, damaging and polluting the environment or act in any way deemed to be detrimental to the environment, such client may be removed from the tour, and no refund shall be made or claimable in respect of any fees and/or monies paid by the client to the owner.

2. The tour organised by the owner is a high-risk activity, taking place approximately 30 meters above the forest floor where one relies on equipment for safety. The structures have been engineered to the highest safety standards and approved by a registered civil engineer. All equipment is of the highest quality and standard. Traverse heights are excessive and clients must be aware that they are suspended on a steel cable with a pulley for a prolonged period. Clients must at all times remain clipped in to the safety ropes/devices, and at no time whatsoever unclip any specific safety device on their own accord. Falling is an inherent danger if safety procedures are not adhered to. Any client failing to adhere to safety procedures and instructions may be removed from the tour and in such event and/or happening I may be removed from the tour and shall not be entitled to any refund or any monies paid by me in respect of the tour. All guides are fully trained and during the tour clients are warned against known dangers. Cost of rescue in emergency situations, hospital or medical treatment will be borne by the client.

3. BRAKING IS ESSENTIAL ON THE SLIDES AND IF IT IS FOUND THAT A CLIENT IS NOT COMPETENT TO BRAKE SAFELY THE OWNER RESERVES THE RIGHT TO TAKE APPROPRIATE MEASURES IN THE INTEREST OF SAFETY, WHICH MAY INCLUDE THE REMOVAL OF THE CLIENT FROM THE TOUR/ACTIVITY.

4. I fully understand that the tour is being undertaken by me at my own risk. I hereby freely and willfully undertake the excursion at my own risk and I declare that I am in good health, not pregnant and prepared to act responsibly at all times, including the transport and the hike. I hereby on behalf of myself and my executors, administrators, heirs or successors undertake not to institute legal action against the owner, and do hereby indemnify, hold harmless and absolve the owner, its members, employees, guides, organisers, servants, helpers and agents from any claims of whatsoever nature and/or liability in connection with loss or damage to my property, or injury to myself, or even death, arising from negligence of the above parties or from any cause whatsoever in the course of the excursions organised by the owner.

5. I freely and willfully agree to all the terms and conditions under which the excursion/tour is being conducted. I furthermore freely and willfully undertake to cover all and any costs, which may be incurred for rescue in emergency situations, hospital or medical treatment, and for any transportation cost or evacuation cost by vehicle or aircraft should it become necessary in the event of an emergency.

6. I do hereby indemnify the owner against all actions, proceedings, liabilities, claims, damages, costs, expenses and losses of any nature whatsoever, which may be sustained or incurred by me in consequence of any loss of life, illness, loss or damage to property, luggage or any injury whatsoever and howsoever suffered by me, either in person or property, whether same arises by reason of any act of God, accident, or the negligence, wrongful act or omission on the part of the owner and/or person or persons employed by the owner.
