Service Terms and Conditions

1. Service undertaking
Mosaic Tours and Travel undertakes to provide all services offered subject to the Terms and Conditions set out hereunder, which Terms and Conditions are accepted by the passenger.
Mosaic Tours and Travel guarantees all reservations for scheduled day tours provided it is requested forty eight (48) hours prior to departure.
In order to ensure availability of preferred accommodation on escorted overland tours, it is recommended that reservations are made 30 days prior to departure date.
Mosaic Tours and Travel makes every effort to ensure that services comprising your tour will be executed efficiently and as specified.
Our personnel, both drivers and guides, are trained and possess the necessary qualifications, documents and accreditation.
2. Definitions
Mosaic Tours and Travel means Mosaic Tours and Travel (Pty) Ltd.
Passenger means: individuals, groups, companies or other legal persons using the services offered by Mosaic Tours and Travel and includes the agents of passengers.
Services means: the provision of transportation and/or accommodation and meals as offered by Mosaic Tours and Travel and accepted by the Passenger.
Departure means the scheduled date of departure of the Mosaic Tours and Travel vehicle.
Single Supplement is an additional charge to single passengers/travelers when they occupy a room alone.
3. Prices
Prices are subject to change without prior notification. Prices are also subject to adjustments in the event of changes in government imposed taxes, fuel price, hotel charges, tourism levies and/or the introduction of national, regional or local taxes or levies of whatever nature.
All prices and rates are quoted in South African Rand unless otherwise specified.
Payment in approved currency will be accepted at the exchange rate applied by Mosaic Tour and Travel bankers at the time of receipt of payment.
Any shortfall resulting from exchange rate fluctuations will be for the account of the passenger.
4. Payment
Twenty five percent (25%) of any tour price is due and payable on booking the tour.
Final payment is due and payable 30 days before departure.
Bookings made within 30 days must be accompanied by full payment.
Mosaic Tours and Travel accepts all major credit cards (Mastercard, Visa, Diners Club and American Express).
A surcharge of 3 % applies on the total tour price on all credit card bookings
5. Tour price exclusions
The tour price excludes the following:
Any tips and gratuities is left to the passengers’ discretion.
Personal items (beverages, cigarettes, telephone calls, room service, laundry and other extras)
Air and rail travel unless specified as part of a tour package.
Visas, medical requirements and immigration requirements.
Mosaic Tours and Travel accepts no responsibility if traveling documentation (visas, medical certificates and immigration requirements) is not in order. Passengers should consult their travel agent.
6. Accommodation
Accommodation is as specified in the itinerary or brochure and is based on 2 people sharing a twin bedded room.
The use of specific accommodation is subject to availability.
Mosaic Tours and Travel reserves the right to substitute hotels with other of a similar or higher category at no additional cost to the passenger, even after commencement of the tour.
Single accommodation is available at an extra cost on a first come first served basis.
7. Transportation
Transportation is in an air conditioned SUV , Minivans, Quantums and Sprinters appropriate to the requirements of the tour and based on passenger numbers.
Mosaic Tours and Travel reserves the right to sub contract in an emergency and when this option is exercised substitute vehicles will be compatible in comfort and reliability, as far as circumstances permit.
8. Meals
Meais included are as specified in the tour itinerary. Please check the applicable itinerary for details.
Meals on scheduled day tours are for the passenger own account.
9. Right to decline
Mosaic Tours & Travel reserves the right to decline to accept or retain any person as a passenger.
Passengers shall obey every lawful instruction of any employee of Mosaic Tours and Travel.
Mosaic Tours and Travel shall at its discretion enforce conduct rules.
10. Check in times
Passengers shall check in, at all departure departure points, at least 30 minutes before the scheduled departure time.
Mosaic Tours and Travel does not accept responsibility for any passenger who fails to comply with this condition.
11. Delays
Mosaic Tours & Travel shall not be responsible for the consequences of any delays whether arising from accidents, breakdowns or any other cause .
12. Smoking
Smoking is not permitted on board Mosaic Tours and Travel vehicles. En route comfort stops will be made to accommodate passengers.
13. Child Policy
Children of all ages are welcome on our scheduled day tours.
In respect of Scheduled day tours, children 12 years and older pays the full adult rate.
Children under 12 years qualify for a 50% discount provided they are accompanied by an adult on day tours.
Children 12 years and under pay only 50% of the tour price provided they are accompanied and share the same room with two full paying adults. Restrictions apply to certain tours.
Mosaic Tours & Travel does not supply baby- or children seats and advise guests supply their own seats for children.
Bookings on our escorted overland tours are strictly subject to the availability of child friendly accommodation at the time of request.
14. Cancellation and Tour Amendment
Mosaic Tours & Travel will acknowledge and regard as valid any amendment and cancellation made in writing.
Reservations cancelled within 30 days of arrival date will will incur a cancellation fee to the full value of the service booked.
Amendments and en route cancellations to the itinerary must be confirmed with Mosaic Tours and Travel directly. En route cancellation and amendment may incur additional charges as determined by Mosaic Tours and Travel. Any additional charges incurred as a result of en route cancellation and amendment will be paid directly to Mosaic Tours and Travel.
No refunds will be made for booked services not used or ‘no shows’ by the passenger irrespective of whether they form part of the basic tour price or whether they are pre booked optional arrangements.
Any refunds for cancellations and en route tour amendments is subject to the sole discretion of Mosaic Tours & Travel management
15. Responsibility
Mosaic Tours and Travel does not have direct control over the provision of services by hotels, airlines and suppliers and shall not be liable for any loss, damage ,injury, additional cost, accident, delay or irregularity that may be occasioned by any error or default.
16. Indemnity and Limitation of Liability
Mosaic Tours & Travel is hereby indemnified and exempted from, and shall not be held liable for all claims, any losses or any damages, and or costs, howsoever caused, arising directly or indirectly from these Terms and Conditions and any tours operated or organised by Mosaic Tours and Travel.
Nothing in this Agreement shall operate so as to exclude or in any way limit the Passenger or Mosaic Tours and Travel liability for fraud, or for death or personal injury caused by either’s negligence or any other liability that may not be excluded or limited as a matter of law.
Mosaic Tours and Travel, their employees, agents and associates shall not be responsible for and shall be exempt from any liability in respect of any loss, damage, injury, accident, delay or inconvenience to any person or their luggage or other personal property whether the same shall arise from or be occasioned by negligence of Mosaic Tours and Travel, their employees, agents, associates and other persons indirectly in the employ or service of Mosaic Tours and Travel or otherwise under any circumstances.
17. Governing Law
These conditions, and the relationship between Mosaic Tours & Travel and the Passenger, are governed by the Laws of the Republic of South Africa and the passenger consents to the exclusive jurisdiction of the South African Courts in respect of any claims and/or disputes which may arise between Mosaic Tours & Travel and the passenger or agent
18. Standard and Safety
Mosaic Tours & Travel will provide vehicles which are large enough to accommodate passenger numbers and luggage.
Mosaic Tours & Travel drivers and guides are licensed in terms of local legislation.
All vehicles are safe and comply with relevant safety regulations.
19. Health and Safety
It is the responsibility of the agent and the passenger to ensure that all relevant and necessary documentation (visas, medical certificates) and all medication are attended to prior to travel. Mosaic Tours and Travel accepts no responsibility in this regard.
Passengers undertake that they have made themselves aware of and accept the potential hazards relating to travel. This includes injury, disease, loss and damage to property, inconvenience and discomfort and satisfied themselves prior to booking that they are fit and able to complete the itinerary of the chosen tour.
If the passenger has any pre-existing medical condition they must declare the true nature of such condition at the time of booking and make arrangements for the provision of any medication, drugs or other cause of treatment which may be required during their trip.
20. Alterations
All tours, itineraries, travel arrangements, hotel accommodation and other arrangements are subject to alterations or cancellations at any time without prior notice and for any reason, at the sole discretion of Mosaic Tours and Travel.
Mosaic Tours and Travel shall not be responsible for any damages whatsoever arising from any such alteration or cancellation.
21. Luggage
Luggage is limited to 1 suitcase not exceeding 20 kg per passenger and 1 overnight bag.
Mosaic Tours and Travel does not accept any responsibility for loss or damage to luggage from whatever cause.
Passengers are advised to ensure that they have adequate insurance cover for loss and damage to luggage.
22. Insurance
Passengers are advised to to take out comprehensive travel insurance and to familiarise themselves with any exceptions, limitations and conditions as may be imposed by the insurance company or underwriters issuing the policy of insurance which they select.
Mosaic Tours & Travel holds Passenger Liability Insurance of 5 million Rand per vehicle and Public Liability Insurance of 5 million Rand.
23. Force Majeure
Mosaic Tours & Travel is not liable for failure to perform its obligations if such failure is as a result of an Act of God which includes fire, flood, earthquake, storm, hurricane or other natural disaster.
Mosaic Tours and Travel will not be liable in the event of war, invasion, act of foreign enemies, hostilities (regardless of whether war is declared), civil war, rebellion, revolution, insurrection, military or usurped power or confiscation, terrorist activities, nationalisation, government sanction, blockage, embargo, labour dispute, strike, lock out or interruption or failure of electricity or telephone services or any circumstance beyond our control which results in failure to perform.
24. Disclaimer
Mosaic Tours and Travel, their employees, agents and associates shall not be responsible for and shall be exempt from any liability in respect of any loss, damage, injury, accident, delay or inconvenience to any person or their luggage or other personal property whether the same shall occur or arise from or be occasioned by the negligence of Mosaic Tours and Travel, their employees, agents, associates and other persons indirectly in the employ or service of Mosaic Tours and Travel or otherwise under any circumstances whatsoever.
