4. Responsibilities of the Renter
I agree to: - Use the bicycle in a safe and responsible manner. - Obey all traffic laws, cycling regulations, and safety rules. - Wear a helmet at all times while riding. - Not allow any other person to use the rented bicycle. - Return the bicycle and accessories in the same condition as received, fair wear and tear excepted. - For E‑Bikes: Use the electric assist responsibly, avoid water submersion, recharge only as instructed, and not tamper with the motor, battery, or electrical components.

5. Damage, Loss, and Theft
I acknowledge and agree that: - I am fully responsible for any loss, theft, or damage to the bicycle and accessories during the rental period. - I will be liable for repair or replacement costs in the event of damage, loss, or theft. - Optional insurance (offered) has been explained to me and I have either accepted or declined it. Full day insurance available at R250 per bike or eBike.

6. Health Declaration
I confirm that: - I am physically and medically fit to ride a bicycle. - I do not suffer from any condition that could affect my ability to cycle safely. - I understand that cycling involves inherent risks, including but not limited to falls, collisions, uneven terrain, and traffic hazards.

7. Indemnity and Assumption of Risk
I hereby acknowledge that I participate in the rental and use of E‑Bikes (electric mountain bikes) and/or standard mountain bikes entirely at my own risk.
I understand that E‑Bikes involve additional risks due to increased speed, weight, battery power, and mechanical complexity.
I hereby indemnify and hold harmless Winelands Guide, its owners, employees, agents, and affiliates against any claims, demands, actions, or damages arising from: - Injury, illness, or death sustained while using the rented E‑Bike or mountain bike; - Loss of or damage to personal property; - Battery failure, electrical malfunction, or misuse of E‑Bike components; - Any negligent act or omission on my part during the rental period,
except where such liability cannot be excluded by law.

8. Limitation of Liability
I understand and agree that Winelands Guide shall not be liable for any indirect, consequential, or incidental damages arising from the use of the rented bicycle.

9. Consent and Agreement
I confirm that: - I have read and understood this Bike Rental & Indemnity Form. - The terms have been explained to me and I had the opportunity to ask questions. - I voluntarily agree to all terms and conditions stated herein.
