Gift Voucher Terms and Conditions

1. This gift voucher can be deemed on network.activitar.com or on www.activitar.com but not on any other *.activitar.com domain. It can only be redeemed for the same service that it was purchased for.

2. The method of redemption is to enter the voucher code into the voucher code field on the check-out screen. The system will then apply the value of the voucher (the price of the voucher plus the value of discount received that the time of its purchase) against the purchase price of the service at the time of purchase. Should the voucher be redeemed in a later season where the selling price of the service has been raised by e.g. 10%, the 10% will be outstanding and will need to be paid for online at the time of the purchase.

3. This gift voucher purchase is a non-refundable purchase. It will not be refunded for any cause, but is a currency in the hands of the holder and could be passed on to a third party. See below regarding transferability.

4. This gift voucher by its nature is transferable. Therefore anyone who has the voucher code can redeem it. The voucher can be redeemed only once of course and therefore please ensure that your voucher code is kept secure.

5. This gift voucher is valid for three years.

Note this voucher is offered by Activitar, so the underlying service provider will only be able to assist you once you have made use of the voucher code to book the service.

Service Terms and Conditions

Water Activities (including but not limited to sea kayaking, stand-up paddle boarding, snorkeling and SCUBA diving) is weather dependent. In the event that the weather is unsuitable, Shark Warrior Adventures will re-schedule the trip or
activity or offer an option of another trip or activity either in the same area or at a different location. Clients accept that the itinerary stated in the trip details is indicative only and not a guarantee that a particular route will be followed or
place reached.
In the event of force majeure (unusual and unforeseen circumstances beyond our control, the consequences of which are unavoidable e.g. strike, riot, natural disaster, act of war or terrorism), whereby Shark Warrior Adventures is forced
to cancel or curtail a trip or activity, we will endeavour to provide a suitable alternative, but we cannot pay compensation or accept liability for the return of fees or expenses.
In the event of cancellation by Shark Warrior Adventures for administrative reasons, clients will be offered the choice of the following options: Full refund of all fees and deposit / another booking on a different date or trip or a Shark
Warrior Adventures Credit Voucher to the value of the trip or activity value. Clients accept that they are medically fit and competent to partake of the offered activity.
If in the opinion of Shark Warrior Adventures staff that a client’s fitness or competence is such that it could compromise the safety of the activity, Shark Warrior Adventures reserves the right to cancel or terminate the trip or activity.
If in doubt, clients are requested to please discuss health and competency issues with Shark Warrior Adventures staff prior to booking. If a client is affected by a medical condition which may affect his/her or other client’s safety or enjoyment of the trip or activity, said client must advise this to a shark Warrior Adventure Centre staff member at the time of booking. It is a condition of booking for all expeditions that participants are willing to sign the Assumption of Risk /Indemnity Form provided by Shark Warrior Adventures, in order that they are covered by third party liability insurance. It is also required that each participant is personally covered by their own adequate insurance for the duration of the itinerary and for the activities undertaken. The insurance must include cover for medical and emergency expenses (including repatriation), personal accident, injury and death. In the event of emergency
medical expenses the responsibility of such costs will be borne by the client.
Any participant under the influence of drugs or alcohol will not be permitted to take part in any trip or activity. Shark Warrior Adventures reserve the right to exclude any participant for safety reasons at any time; no refund on trip fees paid will be given.
Shark Warrior Adventures ensures all participants that guides acting under the
Shark Warrior Adventures name similarly may not operate an activity while under the influence of any restricted or unrestricted substance (including marijuana) of a sort that may influence the outcome, safety or enjoyment of an
activity by clients.
If a client leaves a trip or activity, deviates from the prescribed route or undertakes an independent activity during the trip, Shark Warrior Adventures are not responsible for that client’s actions or safety.
The final choice of venue and decision to operate is based on the experience of Shark Warrior Adventures staff and guides. All specialist equipment required for the activity will be supplied by Shark Warrior Adventures. Personal protective equipment supplied must be worn when requested by the Trip Leader and or Guide .
A comprehensive group safety kit including first aid, flares and a working mobile phone is available on all excursions at all times.
Shark Warrior Adventures does not permit unaccompanied children under sixteen (18) years of age to participate in activities. Accompanied children over four (4) years of age may participate. Shark Warrior Adventures will not sell or give out any client’s personal details or e-mail address to any other party. Clients may choose to opt-in to communications disseminated by Shark Warrior Adventures to keep them informed of other trips, specials and events from time to time. Shark Warrior Adventures cannot be held responsible for personal belongings and equipment. Items stored in the Adventure Centre or with Shark Warrior Adventures staff is at client’s own risk. Clients taking valuables on a trip or activity such as mobile phones, jewelery, watches, sunglasses, non-waterproof cameras etc, do so entirely at their own risk and with the understanding that such items may be lost at sea or damaged irreparably by sea water.
Any information provided by Shark Warrior Adventures on such matters as climate, clothing, equipment etc is given in good faith but without responsibility on the part of Shark Warrior Adventures.
There will always be some risk in the adventure activities offered by Shark Warrior Adventures. Some of these risks might contribute to the loss or damage of a client’s personal clothing/equipment, feelings of discomfort, fear,
apprehension, or even accidental injury, illness, or trauma which in extreme but thankfully very rare cases, can be very serious. Whilst Shark Warrior Adventures will endeavor to minimize risk and incident, all kayaking, snorkeling, walking, SCUBA and SUPping activities are undertaken at client’s own risk. If any client has a complaint about the trip or activity undertaken, they are advised to make same known to the Trip Leader or to a Director of Shark Warrior Adventures at the earliest opportunity. Any outstanding complaint not resolved during the trip or activity should be notified to Shark Warrior Adventures in writing within thirty (30) days of the scheduled end of the trip /
activity.
Shark Warrior Adventures strives to enable clients to get as much enjoyment from the activities provided as possible. Shark Warrior Adventures welcomes client feedback and seeks client reviews, comments and suggestions verbally, in
writing, or electronically via the www.sharkwarrior.com, Google, Facebook, Instagram or Twitter accounts. Shark Warrior Adventures are always interested to see any photographs clients may take and will make any photographs or video recorded during a clients’ trip by our guides available to all participating clients at no extra cost. Under no circumstances shall Shark Warrior Adventures be held liable for any direct, indirect, special, punitive, incidental, exemplary, or consequential damages, or any damages whatsoever, arising out of or in connection with the
use, inability to use, or performance of the information, services, products and materials available in this document.
Revisions and updates to these Terms & Conditions may be reasonably applied from time to time.

Cancellation Policy
7 days or less - 25% payable
48 hours or less - 50% payable
24 hours or less - 100% payable
A guest already started on the tour who elects to leave the tour or not continue with the
activity, will not be eligible for a refund.

An experience is fully refundable if:
- Cancellation is at least 30 days before the schedueled departure date.
- Cancellation is due to extenuating circumstances.
- Cancellation is due to bad weather / unsafe conditions.

Customer Privacy policy
Shark Warrior Adventures shall take all reasonable steps to protect the personal information of users. For the purpose of this clause, "personal information" shall be defined as detailed in the Promotion of Access to Information Act 2 of 2000 (PAIA). The PAIA may be downloaded from:

Payment options accepted
Payment may be made via Visa and MasterCard.
Card acquiring and security
Card transactions will be acquired for Shark Warrior Adventures via PayGate (Pty) Ltd who are the approved payment gateway for all South African Acquiring Banks. PayGate uses the strictest form of encryption, namely Secure Socket Layer 3 (SSL3) and no Card details are stored on the website. Users may go to www.paygate.co.za to view their security certificate and security policy.
Customer details separate from card details
Customer details will be stored by Shark Warrior Adventures separately from card details which are entered by the client on PayGate’s secure site. For more detail on PayGate refer to www.paygate.co.za.
Merchant Outlet country and transaction currency
The merchant outlet country at the time of presenting payment options to the cardholder is South Africa. Transaction currency is South African Rand (ZAR).
Responsibility
Shark Warrior Adventures takes responsibility for all aspects relating to the transaction including sale of goods and services sold on this website, customer service and support, dispute resolution and delivery of goods.
Country of domicile
This website is governed by the laws of South Africa and Shark Warrior Adventures chooses as its domicilium citandi et executandi for all purposes under this agreement, whether in respect of court process, notice, or other documents or communication of whatsoever nature.
Variation
Shark Warrior Adventures may, in its sole discretion, change this agreement or any part thereof at any time without notice.
